Former President Director of Pertamina Karen Agustiawan Sues PWC Accounting Company for IDR 1.2 T

Former President Director (Dirut) of PT Pertamina Karen Agustiawan sued accounting company PT PricewaterhouseCoopers Consulting (PWC) Indonesia at the South Jakarta District Court (PN Jaksel).

This lawsuit relates to him being named a suspect by the Corruption Eradication Commission (KPK) for alleged corruption in the purchase of liquefied natural gas (LNG).

Information about the lawsuit has been confirmed by South Jakarta District Court Spokesperson Djuyamto, that the lawsuit is true. The South Jakarta District Court has also scheduled the first trial for December 12, 2023.

This lawsuit was filed in detail by the plaintiffs on behalf of Galaila Karen Kardinah alias Karen Agutiawan, Hari Karyuliarto and Djohardi Angga Kusumah. Then the defendant is PWC.

In the petitum sent by the South Jakarta District Court, PWC or the defendant has committed unlawful acts regarding reports related to investigations into the management of the LNG business.

“Declare that the Pertamina (Persero) LNG Portfolio Business Management Investigation Report Final Report dated 23 December 2020 prepared by the Defendant is void and has no binding legal force,” wrote the petitum.

For this reason, Karen and others sued PWC for losses of IDR 12 billion. His party is demanding compensation of US$ 78 million or the equivalent of Rp. 1.2 trillion.

“Punish the Defendant to compensate the Plaintiff in cash, immediately and simultaneously, namely: Material Losses experienced by Karen Agustiawan and Hari Karyuliarto totaling Rp. 12,096,000,000. Immaterial losses amounting to US$ 78,000,000 or equivalent to Rp. 1,216,800,000,000 ,” explained the petitum.

Apart from demanding the value of the losses, Karen and the others also asked PWC to submit an apology which was then broadcast in newspapers and online for three consecutive days. Then also asked PWC to pay what was forced if it did not comply with the legal decision.

“Punishing the Defendant to pay forced money (dwangsom) in the amount of Rp. 10,000,000 (ten million rupiah) for every day of delay if the Defendant does not submit and obey in fulfilling this decision, which is legal under the law and paid in cash and at once,” continued the petitum. .

For information, quoted from Detik newsthe Corruption Eradication Committee (KPK) has named Karen Agustiawan as a suspect in the alleged corruption case in the purchase of liquefied natural gas (LNG) which is said to have cost the state IDR 2.1 trillion.

“The actions of the GKK alias KA caused and resulted in state financial losses amounting to around USD 140 million, which is equivalent to IDR 2.1 trillion,” said KPK Chairman Firli Bahuri, last Tuesday (19/9/2023).

Firli said this case started when Pertamina had plans to procure LNG in Indonesia in 2012. This discourse, said Firli, emerged as an effort to overcome the gas deficit in Indonesia.

Karen then proposed collaborating with a number of LNG producers and suppliers abroad, including the Corpus Christi Liquefaction (CCL) company, an LLC company from the United States. The Corruption Eradication Committee (KPK) suspects that Karen made the decision unilaterally.
