Former KPK Chairman Criticizes Vice Chairman’s Attempt to Extend Tenure with Judicial Review

Vice Chairman KPK Nurul Ghufron submitted a judicial review of the KPK Law to the Constitutional Court (MK) and requested that the tenure of the KPK leadership be changed from 4 years to 5 years. Former KPK chairman Abraham Samad strongly criticized Ghufron’s move.

“So the lawsuit filed is more for his personal interests, not for the interests of the institution or the corruption eradication agenda. So this is more for the greed of power,” said Samad when contacted, Tuesday (16/5/2023).

He considered that the judicial review was Ghufron’s attempt to extend his tenure at the KPK. He suspects that this is also related to the minimum age limit for KPK leaders.



“Don’t blame people if anyone thinks that Ghufron deliberately wants to extend his term of office. Because if he is 5 years old, it means that next year he will be 50 years old. If this year ends he is only 49 years old, so (extended) so that next year he will be 50 years old.” ” he explained.

For information, the KPK Law as a result of the 2019 amendment regulates the minimum age limit for KPK leaders to be 50 years. Meanwhile, the old KPK Law stipulated the minimum age for KPK leaders to be 40 years.

Ghufron himself is still 49 years old this year. He was elected as KPK leader in 2019 when he was 45 years old. The DPR itself stated that the KPK Law did not apply retroactively to Ghufron because Ghufron’s election had taken place earlier than the ratification of the KPK Law.

Returning to Samad, he highlighted Ghufron’s reasons for comparing the tenure of the heads of 12 other state institutions which had 5 years. According to him, this was only Ghufron’s argument in facilitating personal interests in his judicial review.

“In my opinion, the argument used by Ghufron only wants to strengthen his personal argument. In fact, this is only for his personal interests, but he postulates it. He forgets that the KPK has a specificity as an institution. It is definitely different from other institutions. Why should it be forced,” he said.

Abraham Samad hopes that the Court will reject the judicial review proposed by Ghufron. He considered that the judicial review was not related to the interests of the KPK or the eradication of corruption in Indonesia.

“In my opinion, what Ghufron put forward is that if the MK really thinks progressively and solely wants to save the eradication of corruption and the KPK institution, then a lawsuit like this must be rejected,” he said.
