Former head of the CEC with a powerful attack on the Commission: This is not a good sign! – 2024-09-09 05:40:14

The case with the two DPS is expected to be considered at today’s meeting of the Central Election Commission (CEC), after neither Dogan’s “Democracy, Rights and Freedoms – DPS” nor Delyan’s “Movement for Rights and Freedoms – New Beginning” Peevski complied with the Commission’s instructions.

The CEC can also deny participation in the elections to both formations in this format, and the decision can be appealed in court.

It is not a good sign for the CEC to delay the registration of one participant in the elections for such a long time, the former chairman of the Commission, Adv. Alexander Andreev regarding the problem of registering the two DPS for the upcoming early elections.

“Everyone expects that the CEC will eventually make its decision regarding the registration or not of the two coalitions. This question has been open for quite a long time. However, September 11 is the deadline for registration of parties and coalitions. If the registration of any of the the coalitions, it also has an additional period of up to 35 days before the elections. It does not give a good sign of the Commission’s work from this point of view – to delay the registration of one participant in the elections. The CEC should meet today and give an answer to the question of which of the two and whether he will register them or not, so that from now on the participants can take the appropriate actions to defend their position,” he commented.

The CEC is a collective body that makes its decisions with 2/3 of those present at the meeting, Andreev reminded. In the absence of such a majority in the Commission, this is a rejection decision, he pointed out and explained: “In the case of a rejection decision, the proposed draft decision itself, which was discussed within the CEC meeting, is rejected. It is also a decision with a number and is subject to on appeal to YOU.”

“In themselves, the instructions are part of the overall registration procedure, and it would follow that the final act of registration or its refusal should be subject to independent appeal, and not the intermediate actions that the CEC performs within this procedure,” the expert also noted.

“Instructions given in a negative aspect, i.e. to remove someone from a particular coalition, whether it is DPS or another political party, is something that in itself I believe should not be right by from the point of view of wanting to remove a political force”, Alexander Andreev expressed his opinion, noting, however, that there is a lack of sufficient information and reasons that led to this decision. According to him, the instructions are expected to give positive guidelines on how to supplement or correct documents so that they can be related to the law.
