Former Director of Basauri Municipal Theater Avoids Jail Time in Fraud Case

The former director of Social Antzokia, the municipal theater of Basauri, Gerardo Ayo, will not finally sit on the bench for an alleged crime of fraud. From June 9 to the 14th of the same month, whoever had been in charge of the Casa de Cultura Basauritarra for the last thirty years, was going to be tried for allegedly having received double allowances from the Basque Government and from the local institution for ten years, from 2007 to 2017.

As reported this Thursday by the Basauri City Council, Ayo has acknowledged the facts, his guilt and has reached an agreement with the Public Prosecutor for which he will fully pay the amount claimed to the Basauritarra Consistory. For its part, the local institution, governed by PNV and PSE, gives its agreement to the pact considering that “it is fully satisfied, especially with the full payment of civil liability and the recognition of the facts, as well as their criminal nature” They have clarified in a press release.

In this way, Ayo avoids the prison to which he could have been sentenced, if the facts had been proven. The Public Prosecutor’s Office applies a mitigation to repair the damage caused by compensating the economic damages and establishes the legal classification of “continued crime of fraud” for which the former municipal technician is sentenced to 1 year 1 month and 15 days in prison, which You must not comply as you do not have a criminal record. In addition, he must pay a daily fee of 6 euros for 3 months and 22 days.

Ayo undertakes, therefore, to return 37,125 euros that correspond to the doubled expenses during those years. Previously, in 2019, he returned another 2,532 euros, which he also requested irregularly.

“Very serious”

The mayor, Asier Iragorri, this morning informed the different political parties in the Board of Spokespersons of the agreement reached and with which the government team is “satisfied.” From Elkarrekin Podemos, who was the promoter of the investigation and who had been denouncing improper charges for four years, they have regretted that the agreement was taken “apart from the rest of the parties.” “When the City Council decided to put the matter in court, it consulted with all the municipal groups represented and now, on the other hand, PNV and PSE reach an agreement without consulting us,” they have pointed out.

From the coalition they have pointed out that “things have remained uninvestigated such as the charges also made by Gerardo Ayo in Redescena.” “It is a very serious crime and since he is a man of the party – in reference to the PNV, a formation for which he was responsible in Basauri – they have reached an agreement to dilute the issue,” they criticized. Municipal spokesmen have preferred not to make statements to an agreement that they have recalled “the prosecutor has accepted and the City Council agrees.”

The Consistory decided in 2020 to initiate an investigation and, after the first verifications, the Consistory temporarily suspended said municipal worker from his duties, who is currently retired and for whom a disciplinary file was opened. The municipal officials forwarded the complaint to the Public Prosecutor’s Office and last year the Bilbao Investigating Court No. a continuous crime of fraud and illegal exactions in the form of fraud and the crime of falsifying an official document, both committed by a public official.
