Many foreign tourists have canceled their vacation plans in Labuan Bajo, West Manggarai, NTT, for this reason new penal codeespecially in articles relating to adultery. Didik Mukrianto, a member of Commission III of the DPR from the Democratic Party faction, said he did not fully understand the penal code.
“The understanding of the substance of the articles of the Criminal Code must be read in its entirety and understood in depth,” Didik told reporters on Thursday (8/12/2022).
Didik explained that the articles related to adultery and cohabitation actually prevent the potential for criminalization. According to him, this article can be applied if there are complaints from close people, not just anyone.
“Crimes of decency, especially adultery and cohabitation, are crimes of denunciation and denunciations are very limited, i.e. husbands or wives for married people; or parents or children, for people who are not married” Didik said.
“Without complaints from subjects who have the rights referred to in the penal code, it is not possible to proceed”, he continued.
You see that the public didn’t fully understand the article. Indeed, Didik said, the article aims to provide legal certainty.
“So to conclude it would be wrong. These very provisions will provide legal protection and legal certainty to prevent potential criminalization by any party,” Didik explained.
According to him, articles 413 and 414 were thus regulated. He said that criminalization cannot be carried out in the name of any interest and by anyone except those regulated by the penal code.
“The reason is firm, clear, concrete and not multiple interpretations,” he added.
Didik stressed that understanding the Criminal Code takes time. For this he encouraged the socialization of the penal code to be massive.
“We hope the government immediately socializes and provides a comprehensive understanding so that all parties can get an understanding that is not wrong. I think if this socialization is done massively and comprehensively, 2 years is enough time to provide an understanding to the public,” he said.
