With the aim that the constitutional reforms are not subject to protection or challengesthe parliamentary group of the National Regeneration Movement (Morena) in the Senate of the Republic presented a initiative in this matterwhich is known as “constitutional supremacy.”

This same day, the Senate Plenary considered that President Claudia Sheinbaum Pardo lacks the powers to eliminate, from the Official Gazette of the Federation, the Decree that reforms various provisions of the Political Constitution on the Judiciary, as ordered by the head of the Nineteenth District Court in the state of Veracruz, Nancy Juárez Salas.

The president of the Board of Directors, Gerardo Fernández Noroña, informed the assembly that a letter signed by Ernestina Godoy Ramos, legal advisor of the Federal Executive, was received, in which she formulated a query to the Chamber of Senators in relation to the amparo resolution. 823/2024, which obliges the head of the Federal Executive Branch to eliminate the publication in the Official Gazette of the Federation of said Decree.

He mentioned that article 7 Bis of the Law of the Official Gazette of the Federation and Government Gazettes clearly and without a doubt establishes the mandatory principle of the integrity and inalterability of the Official Gazette of the Federation.

Fernández Noroña made it clear that the publication in the DOF of said Decree was a direct and immediate consequence of the exceptional and inherent powers of the Permanent Constituent, provided for in constitutional article 135.
