Five mayors of Seine-Saint-Denis sued by the State

The mayors of Bobigny, Montreuil, Stains, Noisy-le-Sec and Tremblay-en-France were summoned before the administrative court on Wednesday. The prefecture criticizes them for not having applied on January 1, the reform of working time in the communities. They are asking for a delay in applying the law.

The towns of Bobigny, Montreuil, Stains, Noisy-le-Sec and Tremblay-en-France are being prosecuted for not having applied the “1607 hours” reform which obliges municipal agents to work 35 hours a week within the framework of the Territorial Public Service Transformation Law.

Patrice Bessac, Mayor of Montreuil, Abdel Sadi, Mayor of Bobigny, Azzédine Taïbi, Mayor of Stains and Olivier Sarrabeyrouse, Mayor of Noisy-le-Sec held a press conference in front of the Administrative Court of Montreuil. They have denounced the Law of August 6, 2019 and deplore a social regression.

Passed in 2019, the civil service transformation law imposes the application of 35 hours to all civil servants, i.e. 1,607 hours of effective work per year. This provision implies the abolition of derogatory regimes, more favorable on working time, in place in certain administrations.

Patrice Bessac does not lose his temper and denounces an attack on the free administration of local communities. “That the State, which could not have managed the health crisis without municipal agents (manufacture of masks, maintenance of school buildings, opening of vaccination centers, collection of food donations, food distributions, sheltering, home care , mobilization in nursing homes, etc.) leaves local authorities and their elected representatives to deal with these issues, freely to administer themselves, as close as possible to the field, according to the needs of the inhabitants” declared Patrice Bessac, communist mayor of Montreuil who plans to seize the constitutional council.

In Montreuil, the annual working time of the 2000 agents is 1552 hours. Collective negotiations began last spring in the midst of a health crisis but were unsuccessful. The mayor had requested additional time to apply the principle of “1607 annual hours which he considers to be a provision for questioning the social achievements”, can we read in a press release from the city. Indeed according to the law, the working time of the agents would increase.

In Bobigny, agents work an average of 1,544 hours per year, or 63 hours less than the legal obligation. For Stains, this duration is 1.565 hours

Cities are liable to a heavy financial fine of 1000 euros per month and per agent. Representing an amount of 2 million euros for the city of Montreuil for example.

The judgment of the administrative court is expected on Tuesday, January 25.
