First trial for Maradona’s death begins with preliminary hearing

San Isidro. The first of the trials for the death of Diego Maradona, which occurred in November 2020 after head surgery, began this Wednesday with a preliminary hearing in Buenos Aires that defines the evidence and witnesses in the process against one of the eight defendants.

The accused, nurse Gisella Madrid, was present at the preliminary hearing of a jury trial in which the evidence of the case was presented, reported her lawyer Rodolfo Baqué.

“In this hearing prior to the debate, the evidence is offered and, if we agree, a date is set for the selection of the jury,” he told reporters in front of the San Isidro court, on the northern outskirts of Buenos Aires.

Jana, one of Maradona’s daughters, as well as the star’s ex-wife Verónica Ojeda were present in the room.

“Do you think the nurse could have had intention, desire, intent, desire to kill him, or economic interest? This trial is absurd,” the lawyer told reporters in front of the court, estimating that the debate will begin in November.

Madrid is accused along with seven other health professionals who were in charge of Maradona’s care while he was under home confinement in a home on the northern outskirts, where he died while convalescing.

But only Madrid will be tried in a jury trial after a request from its defense. The oral trial for the rest of the accused will begin on March 11, 2025, as established in the case.

They are the neurosurgeon Leopoldo Luciano Luque, the psychiatrist Agustina Cosachov, the psychologist Carlos Ángel Díaz, the coordinating doctor Nancy Forlini, the nursing coordinator Mariano Perroni, the clinical doctor Pedro Pablo Di Spagna and the nurse Ricardo Omar Almirón.

All are charged with “homicide with eventual intent” (involuntary) and face possible sentences of between eight and 25 years in prison.

Maradona, considered one of the best footballers in history and world champion with Argentina in 1986, died at the age of 60 on November 25, 2020 in his sick bed, convalescing from surgery for a head hematoma suffered in a home accident.

According to the autopsy, the idol of the Argentine Boca Juniors and the Italian Naples died due to “acute pulmonary edema secondary to exacerbated chronic heart failure.”

On Tuesday, the court approved the eventual transfer of Maradona’s remains from a cemetery in Buenos Aires to a mausoleum that has yet to be built in the center of the Argentine capital under the name “M10 Memorial”, as requested by his daughters.
