Fines totaling 1,480,000 euros were imposed by the Ministry of Development on 11 companies following audits carried out by the Interagency Market Control Unit (DIMEA) and the Consumer Protection Directorate.
They concern violations of the provisions on fictitious discounts and offers, but also non-compliance with consumer legislation.
Particularly:
1. For violations of the provisions of paragraph 2a of article 15 of Law 4177/2013, regarding the implementation of misleading discounts and offers to consumersfines totaling 1,380,000 euros were imposed on seven companies.
In accordance with the provisions of article 13a of Law 2251/1994, regarding the announcement of the names of companies that were fined more than 50,000 euros, the following fines were imposed:
2. For violations of Law 2251 of Law 2251/1994 on the protection of consumer rights, fines totaling 100,000 euros were imposed on four companies.
More specifically, a fine of 80,000 euros was imposed on the company PLAISIO COMPUTERS AEBE for violations related to:
• Delay in refund beyond 14 calendar days, as provided by law, after cancellation of an online order by the consumer.
• Inaccurate information to consumers in the terms of use of the company’s online store regarding the right to unreasonably withdraw from distance contracts, within 14 calendar days of receipt of the product.
• Referral of consumers to the commercial guarantee provider if a product does not meet the contract, but also non-acceptance of its relevant obligations.
• Abusive terms of transactions concerning the terms of use of the company’s online store such as:
1. Limitation of Liability for Hidden Product Defects
2. Limitation of the period in which the consumer must submit complaints or raise his claims against the supplier
3. Shifting the responsibility of the seller to the producer of the good or to another
• Providing incorrect information about the availability, price, specifications and delivery time of the products.
The Minister of Development Kostas Skrekas stated: “The strict adherence to the law by all is non-negotiable. It is proven in practice that the controls carried out are universal, intensive and effective. Unfair practices that distort the criteria of consumers are not accepted and offenders face heavy fines. We are not taking a step back in our effort in order for the entire supply chain to operate legally in the context of healthy competition in favor of consumers and the businesses themselves.”
