File an objection now and meet the deadline!

Have you received an interest notice from L-Bank?

Companies, freelancers and self-employed people from Baden-Württemberg who have already repaid the Corona emergency aid are currently receiving new demands: The L-Bank is demanding interest on the aid money that has already been reimbursed. However, these decisions can be legally challenged!

Is the interest notice legal?

L-Bank already sent thousands of refund notices to Corona emergency aid recipients in March. Anyone who has repaid the required amounts will now receive additional interest charges. However, this interest only has to be paid if the underlying revocation of the approval decision was lawful. In many cases this might not be the case!

Two successful judgments by the law firm of Buttlar Rechtsanwälte before the administrative courts in Freiburg (case number 14 K 4126/23) and Stuttgart (case number 15 K 7081/23) show that L-Bank acted unlawfully in certain cases. The courts decided that the requirements for emergency aid and the notices were often not clearly defined. If the revocation of the approval notice is invalid, the interest notice does not have to be paid.

Act now: file an objection!

If you have received such an interest notice, you should definitely file an objection within the deadline. The deadline is one month from receipt of the decision. After this period has expired, the decision becomes final and the interest payment can no longer be contested. Don’t miss the deadline and get legal advice!
