Fief: Trial after fatal shots outside a café

The 32-year-old defendant admitted that he shot, but limited: “Without my wanting to. I was afraid because so many people were accommodating”. One person had a knife with him, he felt threatened.

Missed Bosnian slap in front of cafe

The 24-year-old Bosnian had come out of the pub scolding and touched him in passing, said the casual worker to the presiding judge Bettina Maxones-Kurkowski. “I said go away.” Finally he slapped the man in the face. The man then went back into the restaurant and came out with his father and several people.

Fief: weapon taken out of friend’s pocket?

His friend, the 35-year-old co-accused, still wanted to calm the aggressive situation in front of the cafe and solve the problem, said the 32-year-old. “I knew he had a gun in his shoulder bag.” He took the pistol out of the 35-year-old’s pocket and shot it towards the 24-year-old’s leg to stop the aggression.

Defendant: “I wanted to run away”

“Without me wanting to,” said the accused. “I saw that I scored and wanted to run away.” Then the father of the injured man came up to him with outstretched arms. The 32-year-old justified firing the shot at the 46-year-old Bosnian man, saying that he wanted to hurt him with the gun, not difficult, just to “run away”. “I didn’t want to kill him.”

According to prosecutor Sandra Lemmermayer, the Bosnian was fatally hit on the upper body, he died “on the spot”

Shots from a distance of two meters

At the crime scene reconstruction in November, the 32-year-old had explained that the shot at the 46-year-old had been released when he was shot at. According to the report, the shots were fired at least two meters away from the father and son.

After the fact, some media have speculated that the background is in the drug environment and that it could be a contract murder. The judge asked “provocatively” whether he should have killed someone in Salzburg, as she said herself. “No,” replied the accused curtly.

Gun according to co-accused by unknown

The chairwoman confronted the previously undamaged Albanian with the information of the 35-year-old co-accused that the weapon did not come from the 35-year-old, but from an unknown person who walked past the sidewalk during the dispute and said “shoot it, otherwise they’ll shoot you “. “That is not the truth,” he replied.

At the beginning of the interrogation, the 32-year-old had apologized for the fact: “I’m sorry for what happened there.” The widow of the dead man reacted emotionally to the accused’s statements. At the request of the judge, she left the room crying with family members to catch herself again.

Lawyer: Shot in the thigh “does not fit”

The 32-year-old lawyer, Mirsad Musliu, said that his client was under the influence of alcohol and drugs on June 4. Already in the morning he started drinking, including whiskey and some lines of cocaine. A lot of alcohol was drunk, “with fatal consequences,” said the defender. The 32-year-old didn’t want to kill anyone. A shot in the thigh “doesn’t fit to kill someone”.

Musliu also referred to different statements from witnesses about the crime. “You won’t know exactly what happened after the trial,” he said to the jury. If there was only one percent doubt that the murder charge should be acquitted, he spoke to the lay judge in his conscience.

For lawyers, it was self-defense

The defender of the 35-year-old lawyer Kurt Jelinek broke into the same horn. Neither could he see any motive for his client to be a contributor. “There was a lot of alcohol in the game. The situation is rocking.” Back then, it was a spontaneous argument with an “unexpectedly violent escalation”.

His client had neither a gun nor a shoulder bag with him, Jelinek explained. Therefore, the 32-year-old could not have made the weapon available. “Another handed over the gun.” The 35-year-old mechanic, who temporarily lived with relatives in Salzburg, stood between the disputes and tried to calm down. And from the shooter’s point of view, a self-defense situation can be assumed, said Jelinek.

The process will continue tomorrow and Thursday.
