FGR and Collado appeal decision not to prosecute lawyers close to Scherer

The Attorney General’s Office (FGR) and the businessman and jurist Juan Collado formally appealed the decision of Judge Jesús Delgadillo Padierna not to link three lawyers and an advisor to the process for the crimes of extortion, money laundering, among other crimes. allegedly linked to former legal adviser to the presidency Julio Scherer.

Judicial authorities confirmed Political Animal that the resources of the Prosecutor’s Office and Collado were presented last night, shortly before the midnight deadline to present the appeal expired. It will now be a federal magistrate who reviews the decision of the aforementioned judge and revoke or confirm it.

In their appeal, Juan Collado’s lawyers They gave five reasons for which they consider that the judge’s decision not to prosecute is incorrect. The first of them is that they consider that Delgadillo Padierna was prevented from resolving this matter due to various personal and family ties.

Among other things, Collado recalls that years ago, in the exercise of his profession, he took the money laundering process against Rene Bejarano, who is the husband of Dolores Padierna. And precisely Judge Delgadillo is the nephew of both. To this is added that one of the lawyers he now denounced, Juan Araujo, and his defender Agustín Acosta, were precisely Bejarano’s defenders.

It is about ties, considers Collado and his lawyers, that compromise the impartial performance of Judge Delgadillo Padierna and who explains, according to them, the reasoning he made at last week’s hearing where he not only ruled that there were no elements to prosecute the defendants, but also accused the victim and the FGR of acting perversely , fabricate evidence and demand that they be investigated.

This argument of the possible conflict of interest and partial action was the same one that, at the time, was used by the defense of the former Secretary of State, Rosario Robles, to try to nullify the action of Judge Delgado Padierna, but it did not prosper.

Collado’s other four arguments are that the judge did not adequately assess the evidence; that there was the possibility that acts with the appearance of crimes were committed; that the judge was inconsistent in his reasoning; and that the so-called “corrupting effect” that the judge held in his determination does not exist.

For its part, the FGR also filed its appeal against Judge Delgadillo’s resolution focused on what they consider to be an inadequate and non-existent assessment of the 75 pieces of evidence they presented to support the initial accusation they presented against lawyers Juan Araujo, César González, Isaac Pérez, and financial advisor David Gómez Arnau.

Previously, the Prosecutor’s Office had already announced in an official statement that it would present this appeal and went further by anticipating that it would open a criminal investigation against the aforementioned judge, added to the presentation of a complaint before the Federal Judiciary Council.

In the next few hours, the Federal Judiciary will turn the review of the resources presented by the Prosecutor’s Office and Collado to a Unitary Court of Mexico City for the analysis of the case. At the same time, both the FGR and the lawyer have the option of presenting an amparo claim.
