The above, given that a parent promoted an injunction under the argument that the creation of the new free textbooks was not carried out in accordance with the law and the protocols established for said action were not complied with.
It was a federal judge who ordered the process of distributing the books to stop, after granting a provisional suspension in relation to the protection promoted by the lawyer Gabriel Vidaña, who in his capacity as the father of the family, argued that these texts do not have support in current academic plans and programs.
The jurist explained that, although the protection was promoted in his capacity as a father, and the suspension would be in relation to his student daughter, the suspension applies throughout the state, since the complaint that contains the appeal for protection is applicable equally to all students in the entity.
Likewise, he pointed out that he would not apply any type of jurisprudence regarding what the Supreme Court of Justice of the Nation issued days ago, because at the time, the magistrates decided to discard the Constitutional Controversy promoted by the legal counsel of the State Government, for This may not be the correct channel to grant a suspension of this nature.
That is, Gabriel Vidaña explained that the SCJN dismissed the Constitutional Controversy, but did not resolve the underlying problem, which is the endorsement or not of what is contained in the free textbooks issued by the SEP.
The provisional suspension was granted since last Thursday afternoon, however, it was this Monday when the petitioner was notified, who will send a copy of the suspension to Governor María Eugenia Campos and her legal team, so that the suspension of the distribution of the copies.
In this sense, he reiterated that this is a legal action that aims to guarantee that students receive a quality education, and that with this it is sought that through legal channels, the necessary content can be generated and that it is properly consulted, created and adhered to the procedures established by law.
It is worth mentioning that the hearing to resolve whether or not to grant the definitive suspension is scheduled for next October 13, however, due to the pressure of time, this could be postponed by about 10 days.
