Federal court orders will be available for withdrawal in January

The Federal Court will make available for withdrawal in January the R$93 billion in court orders paid this month by the federal government, through a provisional measure. The payments include R$27.7 billion in legal cases won by retirees and other beneficiaries of the National Social Security Institute (INSS).

It is up to the federal regional courts to operationalize payments. The Federal Justice Council (CJF) guaranteed that the amounts will be fully transferred by the end of December, and the courts have already informed that the amounts will be available for withdrawal from January, in judicial accounts of Caixa Econômica Federal and Banco do Brasil.

“There is a lot of work to be done to make the decision a reality. The CJF and the Federal Regional Courts (TRFs) work at maximum strength to allow payment to happen”, said judge Daniel Marchionatti, secretary general of the Federal Justice Council (CJF).

The Federal Regional Court of the 3rd Region (TRF3), responsible for payments in the states of São Paulo and Mato Grosso do Sul, for example, informed that deposits must be completed by the end of this week, being available for withdrawal from the 2nd of January. The Federal Regional Court of the 2nd Region (TRF2), which covers Rio Grande do Sul, Santa Catarina and Paraná, reported that the release of accounts for withdrawal is scheduled for January 20th.

The exact date on which the values ​​will be available must be checked in each process, by consulting the portals of the six TRFs. To do this, you need to have the court case number.

Precatório are public debts that are definitively recognized by the courts, without there being any further possibility of appeal. Payments, in this case, are usually made once a year.

With the announcement about the payment of court orders, the Federal Justice Council warns of scammers who seek to take advantage of the situation through telephone scams and messaging applications.

The CJF reminds you that it is not necessary to make any prior payment to receive or anticipate the release of a court order. “There is nothing to do at this time to rush payment,” the agency said. “Do not accept contacts from strangers and, when in doubt, consult your lawyer.”

This year, the payment of court orders by the federal government was carried out through the opening of extraordinary credit, in a provisional measure published last week. The act was published after a decision by the Federal Supreme Court, which authorized the opening of extraordinary credit for the payment of late court orders from 2022, as well as those from 2023.

To this end, the Supreme Court ruled that a ceiling for the payment of court orders that had been proposed in 2021, during the Covid-19 pandemic, by the then government of Jair Bolsonaro, and approved by Congress, was unconstitutional.

The rules considered unconstitutional provided for delaying the payment of court orders until 2027. When questioning the measure in the Supreme Court, the government of Luiz Inácio Lula da Silva claimed that the damming would generate an unpayable debt in the future, of up to R$250 billion.
