Federal Court of Justice reviews rulings in town hall affair

The SPD politician Shostok resigned from his post after charges were brought up and had himself retired. His office manager had received illegal allowances between April 2015 and May 2018. As a result, the city suffered damage of around 49,500 euros. From October 2017 at the latest, Schostok is said to have known of the illegality of the allowance, but not to have stopped it.

The Hanover Public Prosecutor’s Office appealed in both cases. “We have legally assessed it differently,” said spokesman Thomas Klinge on Tuesday. The prosecution had requested a suspended sentence for Shostok for breach of trust through failure. She also sees mistakes in the Herbert judgment. The lawyer of the ex-office manager, Carsten Mauritz, has also applied for an appeal. The goal is an acquittal for his client Frank Herbert, said Mauritz on Tuesday.

Also accused in the trial of the town hall affair was Hanover’s former HR department head Harald Härke. He was sentenced to an eleven-month suspended sentence in three cases in April 2020 for serious infidelity. He also has to pay 20,000 euros to a non-profit organization. In the Härke case, the defense appealed unsuccessfully – this judgment is already final.

The Leipzig judges could decide immediately after the hearing on Wednesday that the decision of the Hanover Regional Court will stand. Then the judgments against Schostok and Herbert would also be final. The BGH could, however, overturn one or both judgments and refer them back to another chamber of the regional court for a new hearing.

As a result of the town hall affair, the SPD had lost the top office in the city administration of Hanover after more than 70 years. The Green politician Belit Onay was elected as Shostok’s successor as Lord Mayor.
