Viagogo is no longer allowed to sell non-existent FC Bayern tickets. A court stopped the dubious practice.
The Munich Regional Court I has made a groundbreaking decision in a legal dispute between FC Bayern Munich and secondary ticket market seller Viagogo. The 37th Civil Chamber banned Viagogo from offering empty tickets for matches of the German record champions and from advertising them with information such as “only a few tickets left”.
Void tickets are tickets that are not yet on the market at the time of the offer. The court justified its decision by saying that this practice would deceive consumers, “because they would otherwise think that they were definitely buying a ticket, even if the sale was ultimately based on speculation. “
FC Bayern Munich sells its tickets through its own website, partly to club members and partly through a secondary market. The cards are personalized to prevent commercial resale. The association’s terms and conditions state that reselling through other internet platforms is against the contract.
Viagogo argued in court that speculative transactions are common in business transactions and that FC Bayern’s terms and conditions would “unduly affect” ticket holders when reselling them. The court did not follow this argument and found that FC Bayern had definitely proven that pricing was not just about maximizing profits, but also about social aspects.
Especially explosive: The court confirmed that the football club had the right to send away fans at the entrance who had bought their tickets through Viagogo. Another accusation by FC Bayern, according to how Viagogo buys tickets through strawmen and resells them at exorbitant prices, could not be proven beyond doubt in court. The court did not see enough evidence that Viagogo was involved in possible justification or name changes on the tickets. The decision is not yet legally binding.
