FBI Informant Accused of Fabricating Biden Bribery Allegation Rearrested in Bizarre Circumstances
In a shocking turn of events, Alexander Smirnov, the FBI informant who was accused of fabricating a $10 million bribery allegation against President Biden and his son Hunter, has been rearrested just two days after his release from jail. The circumstances surrounding his re-arrest have been described as “bizarre” by his lawyers, as he was taken into custody while consulting with them at their law offices in downtown Las Vegas.
Previously, US Magistrate Judge Daniel Albregts had granted Smirnov’s motion for pretrial release on Tuesday, rejecting the Justice Department’s request to keep him in custody. However, the government filed a motion to reopen Smirnov’s detention hearing in the Central District of California, where he had been indicted on charges of making false statements and creating false records.
The sudden re-arrest of Smirnov on the same charges and indictment has raised concerns about the violation of his Sixth Amendment rights. His lawyers argued that the fact that he was attending a legal consultation at their office contradicts any notion that he is a flight risk. They further pointed out that there are no provisions for re-arrest in the Nevada District after being ordered released.
Smirnov’s lawyers have filed a motion for an emergency detention hearing in the US District Court for the District of Nevada, urging the court to hold his “second initial appearance” and release him without unnecessary delay. They also requested an emergency hearing before the Nevada court’s chief judge and asked the US Marshal Service to keep Smirnov in Nevada until another detention hearing can be scheduled.
The initial arrest of Smirnov took place on February 14 when he arrived at Harry Reid International Airport in Las Vegas from overseas. He now faces two felony charges related to alleged false statements documented by the FBI in a June 2020 FD-1023 form. This form had been a subject of contention last year when House Republicans fought for access to it.
Special counsel David Weiss, who is handling the case, argues that the corruption accusations against the Bidens are false because Smirnov was not working with Burisma, the Ukrainian energy giant, at the time he claimed to have had conversations with a key company figure who revealed the bribes. Furthermore, the indictment states that Smirnov holds a bias against President Biden and accuses him of peddling new lies that could impact US elections after meeting with Russian intelligence officials in November.
