Samuel Hutabarat, the late father Brigadier Nofriansyah Yosua Hutabarat aka Brigadier J was very disappointed when he found out Freddy Sambo escape from death sentence.
The sentence of the former Head of Propam Division was reduced to life imprisonment. The Supreme Court (MA) granted Sambo’s cassation.
Samuel admitted that he only learned about the legal process at the Supreme Court after being asked for a response by journalists regarding the Supreme Court decision.
“We were called by a member of the media, that this member of the media asked for a decision from the Supreme Court. We are very disappointed. That disappointment is because we do not know the origins of the decision that reduced the sentence for the accused. Suddenly the verdict,” said Samuel in Jambi, Wednesday (9/8).
The reduced sentences for the defendants Putri Candrawathi, Strong Ma’ruf and Riki Rizal also disappointed Samuel. According to him, he did not know the Supreme Court judge’s consideration of circumcising the defendants who killed his son.
“We don’t know the release. It should have been during the trial what matters were considered by the Supreme Court judges. We don’t know. What we know are that the four people have had their sentences reduced,” said Samuel.
Meanwhile, the legal adviser to the family of Brigadier J, Ramos Hutabarat, presented various evidences showing that there had been a premeditated murder committed by Sambo et al.
“From the beginning and at the time the district court was convinced that there was premeditated murder. There was nothing that relieved Ferdy Sambo for the panel of judges to lighten the sentence,” he said.
During the Supreme Court trial, said Ramos, three judges agreed that Sambo would receive a life sentence, and two judges wanted the former Head of Propam Division to be executed.
“Two judges lost and Ferdy Sambo received a life sentence,” he said.
The Supreme Court (MA) cassation panel consisting of five justices cut the sentences of four defendants for the premeditated murder Brigadier J. The four defendants are former Head of the Propam Division of the National Police Ferdy Sambo, Putri Candrawathi, Rizky Rizal, and Strong Ma’ruf.
Sambo’s sentence was annulled from death penalty to life imprisonment. Putri, who is Sambo’s wife, was reduced from 20 years to 10 years in prison, Rizky Rizal from 13 years to 8 years, and Strong Ma’ruf from 15 years to 10 years.
The Head of the Legal and Public Relations Bureau, MA Sobandi, claimed that there was no intervention by the panel of judges regarding the cassation decision.
He explained that in their decision, the panel of judges rejected the appeal of the public prosecutor (JPU) and the defendants. However, the Supreme Court also made improvements to the qualifications for criminal acts and crimes that were awarded.
“Judges are guaranteed their independence, their independence. So there is no way they can intervene in a decision,” Sobandi said in a press conference, Tuesday (8/8).
