‘Failure to conduct trial properly’; High court slams Palakkad poxo court

Cochin: High court slams Palakkad poxo court in Walayar molestation case The court observed that the judge had failed to conduct the trial properly. The order also said that training should be given to judges in poxo courts. The High Court had quashed the appeal filed by the government and the parents of the children against the acquittal of the accused in the Walayar torture case. The court ordered a retrial in the case. The trial court can be approached for further investigation of the case. The court directed the prosecution to file an application for the same.

The Palakkad-Poxo court had earlier acquitted the accused V Madhu, Shibu, M Madhu and Pradeep on the suspicion that the prosecution had failed to prove the charges against them. However, the government claimed that the release of the accused was due to misconduct on the part of the police and the prosecution. The Special Prosecutor has informed the court that the government is ready for further investigation or re-investigation if necessary. The government argued that the trial court had also failed to examine the evidence. The parents of the children claim that the police have changed the case in favor of the accused from the very beginning.
