He should have been answerable for his actions before the Supreme Court. He narrowly escaped it. He comes off with a stern reprimand as punishment after apologizing to the Bar Council. This is Anoup Goodary, the lawyer was the subject of an investigation by the Bar Council as part of his activities on Facebook and under the provisions of the Mauritius Bar Association Act.
« In light of the above findings the Council was minded to refer the matter to the Supreme Court pursuant to Section 13(3) of the MBA Act but being given his apologies, abeit equivocal, the Council has decided that a reprimand would be the most appropriate sanction in the present matter ». The charges against him are, first, the publication of a ‘comedy video’, then a second video on the conduct of the magistrate of the Bambous district court on February 25, 2021. Whatever he accepted apologizes on the two aforementioned points, the Bar Council considers Anoup Goodary to have infringed Rules 2.3 (a) (i) and (iii) of the Code of Ethics, and that the latter “has been guilty of conduct discreditable to a Barrister ”. It is stipulated that his conduct does not harm the legal profession.
This, adds the Bar Council, is likely to reduce public confidence in the profession, as well as in the judicial administration.
These facts, deplores the Bar Council, have “brought the profession into disrepute”, because he also published on his Facebook page a letter which had been addressed to him personally by the Secretary of the Bar Council.
Note that the facts which are reproached to the lawyer will also be communicated to the Chief Judge and to the Master & Registrar.
