Eye: The relatives filed an appeal – “We will not let it pass, justice was not served” – 2024-05-02 06:20:52

A request for an appeal against the decision in the much-lauded trial for the Mati tragedy was filed before the Athens Appeals Prosecutor’s Office by lawyers representing relatives of the victims and injured, as they argue that “justice was not served”. A day after the provocative decision of the Three-member Criminal Court of Athens, which has caused outrage, not only among the relatives of the victims of the tragedy but throughout Greek society, the lawyers filed an 82-page petition requesting an appeal against the court decision where they point out among other things that “adequate punishment of the guilty is necessary in order not to mourn other dead”.

Specifically, as underlined in the application, the decision issued by the Three-member Misdemeanor Court of Athens is incorrect, as “the guilt of the defendants for all the crimes charged was unequivocally established by the evidence” during the hearing.

With the application, which is simultaneously notified to the Prosecutor’s Office of the Supreme Court, it is requested the “exercise of an appeal against the court decision both for its acquittal order for all the accused who were acquitted and for the parts of the charges that were not accepted”.

“Acts and omissions”

In the application, there is talk of “inadequate judicial judgment of the Three-member Criminal Court of Athens” and indeed “a lenient characterization” as it is pointed out, while it is noted that “adequate punishment of the guilty is necessary so that we do not mourn other dead”. The application also describes in detail for each of the involved persons (acquitted and convicted) a series of “acts and omissions” during the exercise of their duties which resulted in the loss of 102 people’s lives and the injury of another 32.

It should be noted that this morning the Prosecutor of the Supreme Court, Georgia Adelini, intervened, who, by order of the Director of the Athens Appeals Prosecutor’s Office, requested to “investigate the ex officio exercise of the appeal in respect of those acquitted by the decision of the Tripartite of the Athens Misdemeanor Court for the Eye, as well as regarding the recognition of extenuating circumstances for those convicted by the same above decision, the individual penalties imposed on them and the manner in which the penalties were imposed in general”.

It is recalled that the Three-member Misdemeanor Court of Athens acquitted 15 out of a total of 21 defendants and convicted only six, including five senior officers of the Fire Department and the resident of the area who allegedly started the fire that led to the tragedy.

Th. Skyftas: We will exhaust every means to deliver Justice

In a statement to documentonews.gr, the well-known Athens lawyer Dimitris Skyftas, who legally represents relatives of the victims and injured of the tragedy, points out that they will exhaust “every possibility”, as he points out that “justice was not delivered by the court”.

“Because Justice was not rendered by the Three-member Misdemeanor Court of Athens, the families of the victims will exhaust the possibility provided by the law and submit a request to the Prosecutor of Appeals if he appeals against the decision that was issued yesterday and plunged the entire Greek society into grief. We will not let this pass, we will exhaust every possibility because we have the feeling after so much struggle that we have fought that Justice was not delivered yesterday by the court”.
