The guilt of 9 defendants for the fatal fire in Mati was suggested in his sentence by the prosecutor of the seat of the Tripartite Criminal Court of Athens, Panagiotis Maniatis, while at the same time he proposed the acquittal of the remaining 12 defendants. Among those who recommended their release from the charges is the former former regional governor of Attica, Rena Douro and the former general secretary of Civil Protection, Ioannis Kapakis.

Specifically, the prosecutor proposed the guilt of the then deputy chief of the Fire Department, Vasilis Matthaiopoulouof the then leader of the PS, Sotirios Terzoudisof the then head of ESKE, Ioannis Fostierisof the then commander of the Athens Police Department, Nikos Panagiotopoulosof the then commander of the DIPYN, Eastern Attica, Charalambou Hioniof the deputy mayor of Marathon, B. Deathof the then mayor of Rafina – Pikermiou, Evangelou Burnousof the then deputy mayor of Rafina, Ant. Palpate and the resident of Penteli Konstantinos Angelopoulos.
For the specific defendants, the prosecutor ruled that the acts of serial negligent homicide, negligent bodily harm and negligent arson by circumstance were proved.

The exculpatory sentence
With regard to the discharge of the 12 defendants recommended by the district attorney, they are:
Chr. Golfinos (responsible for PA ground means), Phil. Panteleakos (director of civil protection PS), Damianos Papadopoulos (PS), Christos Lambris (PS), Chr. Drosopoulos (pilot of Floga 1 helicopter), G. Portozoudis (commander of aerial means), Stefanos Kolokouris (commander of 1st EMAK), Char. Syrogiannis (ELAS air force commander), Ioannis Kapakis (G.G. of Political Protection), Rena Dourou (then regional governor of Attica), Il. Psinakis (then mayor of Marathon) and Dim. Stergiou – Kapsalis (mayor of Penteli).
For Rena Dourou
With regard to Rena Dourou and the alleged accusation that she did not take care of the deforestation of the area, the public prosecutor pointed out that “it turned out that the only responsibility for the maintenance of the district was Marathon Avenue and it was assigned to a company. The work according to the documents had been carried out.”
The fire prevention planning – said the prosecutor – had progressed and as of 2/3/2018 had sent to the decentralized administration of Attica the list of means and persons for issues related to the disputed projects. There were also the contact details of the district representatives. They were known to the competent prevention bodies of the decentralized administration and, in any case, any delay in sending them did not contribute to the outcome of the fire.
Regarding the failure to provide information to the public, especially vulnerable groups, about the need to take self-defense attributed to Rena Dourou, the prosecutor said that the Region had taken the required actions through messages to the media, with information signs on the streets, etc.
Regarding the convening of the Civil Protection Coordinating Body, he mentioned that the then regional governor, although there was no valid information from the Fire Department, had called an emergency response unit when he received information about the situation after seven in the afternoon.
Finally, regarding the key issue of the non-decision for an organized evacuation of the citizens, the prosecutor emphasized that since there was no recommendation from the Fire Department, the competent bodies of the Region were deprived of the responsibility of making a recommendation.
