Mexico City. After announcing the draft decree of the Chamber of Deputies with which it is intended to expand the catalog of crimes susceptible to applying informal preventive detention, the Office in Mexico of the United Nations High Commissioner for Human Rights (UN- DH) reiterated that “this measure is incompatible with human rights standards.”
Informal preventive detention violates the presumption of innocence, due process, the right to integrity and personal freedom, as well as the effective prosecution of crimes and equality before the law, among others, he stated.
Yesterday, the Board of Directors of the Chamber of Deputies issued the declaration of publicity of the opinion of the Commission on Constitutional Points, which reforms article 19 of the Constitution to establish that the judge will “order” preventive detention informally in cases of “extortion, drug dealing , illicit activities related to fentanyl and other synthetic drugs in accordance with applicable laws.”
Additionally, in cases of “tax fraud, smuggling and any activity related to false tax receipts under the terms established by law.”
