Defense attorney and former federal prosecutor James K. Filan expects the infamous Hinman Speech documents to be made public on June 6, citing a previous court order..
The Hinman documents refer to a 2018 speech by former head of the Securities and Exchange Commission’s corporate finance division, Bill Hinman, who essentially declared that Ether (ETH) was not a value. The documents involve the SEC’s internal discussion and deliberations surrounding this speech.
In a May 17 Twitter thread, Filan, who has been actively following the SEC vs Ripple case for the past two years, provided an update on when the documents might be released to the public..
“In accordance with the Court Order of 9/12/2022, The parties have 21 days to submit redacted public versions of the Summary Judgment documents in accordance with the sealing ruling. June 6 is 21 days since yesterday’s ruling,” he wrote..

Some, however, believe the deadline could be affected if the SEC files an appeal or the case settles..
Another lawyer following the case, Jeremy Hogan, Partner at Hogan & Hogan, he pointed that the SEC has approximately 10 days to file an appeal of this specific order.
However, a tweet from Ripple CEO Brad Garlinghouse on May 16 indicates that Ripple wants to make Hinman’s redacted emails “publicly available soon”.

Although Ripple Labs already has access documents for a long time, sees this aspect of the case as important evidence in his defense against the SEC and his claims that XRP falls under the classification of a security.
The SEC filed a motion in late December to seal the documents to the public, arguing they have “no relevance” to the final outcome of the case. and that the SEC’s mission outweighed the “public’s right” to access documents.
