The night exit restriction in Baden-Württemberg no longer applies since it was no longer overturned on Monday (February 8th, 2021) by the Baden-Württemberg Administrative Court in Mannheim as no longer proportionate. There is still a loophole for counties with a high seven-day incidence. You can still prohibit residents from leaving the house late at night for no good reason. But not all affected districts implemented this option.
Different regulations with different incidences
While in the Ortenau district, whose seven-day incidence per 100,000 population is 66.1 new infections (as of Thursday, February 11, 2021), there are no exit restrictions between 8 p.m. and 5 a.m., the Waldshut and Lörrach districts adhere to the restriction. The regional corona hotspots want to react to a diffuse infection process. According to the state’s regulation, “a significant threat to the effective containment of the spread of the coronavirus” must be recognizable so that health authorities can maintain the exit restriction. This applies, for example, if locally increasing numbers of infections cannot be assigned.
Ordinance applies until February 26th or March 1st
The Ortenaukreis justifies its special route with a broad test strategy – in addition, the contacts of Covid patients are still traceable. In the district of Lörrach, however, a new curfew between 9 p.m. and 5 a.m. has been in effect since Friday (February 12, 2021). The incidence in the district is 58.7. The Waldshut District Office has also issued a new general decree, according to which the restriction between 9 p.m. and 5 a.m. also applies. The rule is initially limited to February 26th, but will be lifted if the incidence falls below 50 on three consecutive days. The current value is 96.5. In Lörrach the regulation applies until March 1st.
The exit restriction has been lifted in the city of Freiburg (incidence 36.3) and the districts of Breisgau-Hochschwarzwald (37.9) and Emmendingen (28.2).
