The draft laws on the organization of SRI and SIE, which are under debate in the governing coalition, provide that the two intelligence services may have the right of legislative initiative, according to documents consulted by G4Media. The current legislation does not provide for such rights for SRI and SIE.
Article 74 of the Romanian Constitution stipulates that only the government, parliamentarians or a number of at least 100,000 citizens with the right to vote have the right of legislative initiative.
What does the draft law on the organization and functioning of the Romanian Intelligence Service provide:
Art. 14 – The Service may initiate draft normative acts related to its field of activity, according to the provisions of the Regulation on procedures, at the Government level, for the elaboration, endorsement and presentation of draft public policy documents, draft normative acts, such as and other documents for adoption / approval.
What does the draft law on the organization and operation of the Foreign Intelligence Service provide:
Art. 5. – (1) In carrying out its functions, the Foreign Intelligence Service has the following main attributions:
r) initiates or, as the case may be, approves the drafts of normative acts related to its field of activity.
Context. According to Prime Minister Nicolae Ciuca, the draft laws were drafted by the institutions themselves – intelligence services, ministries. G4Media has published a series of articles over the past four days that reflect the most important changes brought about by these projects.
The drafts are now being debated by the ruling coalition and are to be adopted by the government and then sent to Parliament for debate. Changes to these projects can occur in both the coalition and government debates and in Parliament.
It is a comprehensive package of 10 laws concerning the operation and organization of intelligence services, the army, the Ministry of Interior and the CSAT. Prime Minister Nicolae Ciuca announced on May 27 that the projects are being analyzed within each party in the coalition, and in a week they will enter the Government’s debate, to be sent to Parliament.
“The laws have been drafted at the level of each responsible institution, the package in its entirety is at the level of each party, so that the specialized commissions can analyze and I think that no later than a week we can have the package for analysis and approval at the government level so that it can be submitted to the Parliament “, declared the prime minister Nicolae Ciucă on May 27th.
