European Court Rules Frontex Not Liable for Deportation of Syrian Family

Today (Wednesday, September 6, 2023), a court of the European Union in Luxembourg ruled that no European Border AgencyFrontex is held liable for damages related to the deportation of a Syrian family to Turkey, because the agency does not have the authority to assess return decisions by member states or asylum applications, a press release said. The court said that only EU member states are “competent to assess the merits of decisions to return and to review applications for international protection.” Today’s ruling can be appealed to the EU’s highest court, the European Court of Justice.

The case was brought by a family of six who were deported from Greece to Turkey in October 2016 on a flight arranged by the agency. Frontex. The family, who now live in Iraq, said Frontex had acted illegally, as their asylum application should have been considered before being taken out of the European Union.

Prosecutors say they were returned to Turkey shortly after arriving in Greece, even though they had applied for international protection. The return of people seeking protection at external borders, the so-called pushbacks, is illegal under international law, according to human rights organizations. Syrian citizens are demanding compensation for material and non-material damages resulting from the return process, according to the legal complaint.
