European Court of Justice Rules in Favor of Autonomous Super League Project, Opposing UEFA

The decision risks becoming a landmark. The Court of Justice of the European Union ruled on Thursday December 21 in favor of the autonomous Super League project opposed to UEFA which until now governs all European football competitions.

The CJEU considers that “the rules of Fifa and UEFA on the prior authorization of inter-club football competitions, such as the Super League, violate Union law Indeed, they are contrary to competition law and free provision of services.”

A year ago, the Advocate General of the European Court nevertheless confirmed UEFA in its general opinion concerning the sanctions on split clubs. This event could well relaunch the Super League project where only Real Madrid and Barça still officially appear after the withdrawal of Juventus.

“The judgment does not support or approve any Super League project”reacted the European Club Association (ECA) chaired by Nasser Al-Khelaïfi, a notorious opponent of the project.

Bernd Reichart, the leader chosen to oversee the Super League, congratulated himself on X (formerly Twitter): “Today there is big news: football is free. Free from UEFA’s monopoly, free to pursue the best ideas without fear of sanctions“. And to announce that the broadcast of this competition would be free and to reveal its outlines.

64 clubs would be divided into three leagues for the men’s tournament and 32 clubs divided into two leagues for the women’s edition. The organization therefore details a new private project, different from the first version of the Super League, since it will not include any permanent member and will operate with a promotion-relegation system, also providing for solidarity payments of at least 400 million euros to European football.

It remains to be seen how those primarily concerned, namely the players in the game and supporters, will receive the news. A revolt coming in particular from England had caused the disintegration of the first completely closed and selective version of the Super League.
