It revolves around a directive from 2016 with which the EU wants, among other things, to prevent international companies from transferring their profits to countries where they have to pay little tax. A certain part of the Belgian law offends the Commission. It concerns the scheme for foreign subsidiaries of multinationals that are established in Belgium and have to pay profit tax in our country.
The Court of Justice can now issue a formal condemnation against Belgium, unless the government takes steps in time to solve the problem. The infringement procedure was already launched in July 2020, but according to the Commission, our country’s response was “not satisfactory”. That can be read in a press release.
