EU judges allow upload filters – Background

Upload filters on content platforms seem to be really coming. The Court of Justice did not fire these filters in a recent court case, but it did identify a number of safeguards that Member States must implement. What’s up with that?

Poland is not known as a country that is committed to protecting fundamental freedoms and the rule of law. Together with Hungary, it is not averse to anti-EU sentiments and is sometimes in the European dock. In the case of Poland, for example, reference is made to the way in which the independence and impartiality of judges is curtailed† You would therefore not immediately expect that this country will stand up for freedom of expression before the European Court of Justice.
