The administrative court of Grenoble annulled, Tuesday, January 19, an order of the mayor of Grenoble, Eric Piolle, which required that people have access to emergency accommodation in the event of eviction from their home. The decree was suspended in June 2019.

Eric Piolle will not succeed. The Grenoble administrative court annulled, on Tuesday January 19, the “anti-homelessness” order of the mayor of Grenoble which required a solution to be found for people evicted from their accommodation, announced the prefecture of Isère.
This decree, taken on May 21, 2019, required that “during any eviction of domicile on the territory of the municipality” from Grenoble, it is provided “to the mayor or his qualified representative the justification that an effective, decent and adapted solution of housing, or where appropriate accommodation, has been offered to the person or persons concerned”. More than a month later, his execution was suspended by the Grenoble Administrative Court on Friday June 28, 2019, pending a decision on the merits.

Piolle strikes back
This decision fell a year and a half after the signing of the decree. In its judgment, the court considers that “the mayor of Grenoble ignored the field of his competence”, because the texts “attribute to the State, and to him alone” these powers regarding tenancy evictions. “It is not for the mayor to make evictions conditional on the creation of local procedures not provided for by the legislative power”, commented the prefecture in a press release obtained from Agence France Presse (AFP).
“The City of Grenoble takes note of the court’s decision”, Piolle reacted in writing to AFP. Believing that “the right to housing and to enforceable accommodation must be respected throughout the territory”, the elected representative intends to counter-attack by financially attacking the State.
When it is certified that in view of the situation of people already supported by the City, the State does not follow the right to housing or enforceable accommodation, the City of Grenoble will proceed with compensation claims, c ” that is to say will invoice the State for the sums committed to implement its powers in its place

Other failed mayors
For his part, the prefect of Isère, Lionel Beffre, recalls “that it ensures compliance with the legislation before each expulsion and the care of people in a place of accommodation, when the regulations and their personal situation justify it”.
In recent years, various mayors of France have taken orders to oppose rental evictions, as in Aubière, in Puy-de-Dôme. All were annulled by the administrative courts.
