(Reuters) – Fortnite creator Epic Games on Friday opposed Apple Inc’s efforts to stay the orders made in an antitrust lawsuit as the potentially lengthy appeal process continues.

U.S. District Judge Yvonne Gonzalez Rogers in September https://www.reuters.com/article/apple-epic-games-idTRNIKBN2G61IK rescinded some of the iPhone maker’s App Store rules, including a ban on developers direct their users to other payment options besides Apple’s in-app payment system, in a partial victory for Epic and other app makers.

Apple has until Dec. 9 to comply with the injunction, but earlier this month the company said it would appeal the ruling and asked Gonzalez Rogers to postpone its order as the process continues. ‘call begins, which could take over a year.

On Friday, Epic argued in a lawsuit that Apple did not meet the legal standard for this suspension, forcing Apple to show that it will suffer irreparable harm even by temporarily complying with the injunction if the injunction is thereafter. overturned on appeal.

Epic said Apple’s positive comments on the decision shortly after it landed, and its delay in requesting a break, showed it would not be hurt issuing the orders.

“The public interest would prefer to deny (Apple’s request); an injunction is the only way to get effective relief, ”Epic wrote. “History shows (…) that in the absence of an injunction, Apple will not make any changes.”

Apple did not immediately respond to a request for comment.

A hearing on Apple’s claim is scheduled for November 9.
