The Public Prosecution Service (OM) and the police are “ready to enforce the nitrous oxide ban”, the OM reported on Saturday. Since 1 January this year, it has been prohibited to transport, sell, produce or possess nitrous oxide for recreational use within the Netherlands. But enforcement has not yet been done.
Last November, the police said they were in favor of a ban, but that a few things had to be arranged before enforcement was possible. For example, a solution had to be found for the transport and destruction of seized nitrous oxide.
Now that the Public Prosecution Service and the police are ready for this, a public prosecutor will assess “whether prosecution will take place on the basis of facts and circumstances in the official report”, the Public Prosecution Service said in a statement. Criteria from the Opium Act criminal procedure directive are followed.
The penalty varies. Community service or fines up to imprisonment may be imposed. Penalties become higher as a larger amount of nitrous oxide is found.
Legal uses continue. This concerns (veterinary) medicine, medical devices, technical industries, catering and the food industry. There must be a permit for that.
