The judge sentenced Metty Kapantow, the employer who tortured her household assistant (ART), Siti Khotimah, to 4 years in prison in the case torture the. The national coordinator of the Domestic Worker Advocacy Network (Jala PRT), Lita Anggraini hopes that the public prosecutor (JPU) will appeal the verdict.
“It’s up to the prosecutor to appeal, but if we, the people who are fighting for justice, if the prosecutor has a conscience, he should appeal. If he talks about justice, not making the legal process a market transaction with restitution, he should appeal,” said Lita Anggraini to reporters, Monday (24/7/2023).
Lita said the 4-year sentence did not reflect Siti Khotimah’s sense of justice. According to him, Metty Kapantow should be sentenced to more than 11 years in prison.
“It is clear that the decision of the panel of judges in today’s SK case does not reflect a sense of justice, which also creates a deterrent effect for the perpetrators of violence in such a brutal way, and the punishment should be a layered sentence, domestic violence, the Criminal Code and TPKS, yes, and the law should be more than 11 years, 15 years,” he said.
Lita also highlighted the provision of Rp. 200 million in assistance from Metty, which was one of the things to lighten the sentence. He called the trial verdict like setting-an.
“So seeing the trial process so far, it’s like the trial is a drama setting-an. First, it was shown that there was assistance for Siti Khotimah’s family. And the Panel of Judges stated that the assistance would not affect the decision. But then in the last reading the decision was deemed to be a mitigating part. So that’s one form setting-an,” he said.
Furthermore, Lita said restitution should not lighten the verdicts of the defendants. According to him, restitution is the right of Siti Khotimah as a victim.
“This legal process does not reflect a sense of justice and sees it as a transaction process, restitution for compensation but it cannot be relieved, because it is part of the victim’s rights. And restitution is far from suffering, including immaterial suffering,” he said.
Previously, the employer of Siti Khotimah’s household assistant, Metty Kapantow, was sentenced to 4 years in prison in a case of maltreatment. The judge stated that Metty Kapantow was legally proven and guilty of physically abusing Siti.
“At trial, decided, stated that the defendants Metty Kapantow, defendant So Kasander, defendant Jane Sander, defendant Evi, defendant Sutriyah, defendant Inda Yanti, defendant Pebriana Amelia, defendant Saodah and defendant Pariyah have been proven legally and convincingly, guilty of committing the crime of committing and ordering to commit physical violence which resulted in serious injury which was carried out continuously,” said chief judge Tumpanuli Marbun in a hearing at the South Jakarta District Court, Jalan Ampera Raya, South Jakarta, Monday (24/7).
“Sentenced a sentence against the defendant Metty Kapantow, therefore, with a prison sentence of 4 years,” he added.
The judge stated that Metty Kapantow’s husband, So Kasander, and their child, Jane Sander, were also proven to have physically abused Siti. So Kasander was sentenced to 3.5 years in prison.
“The defendant So Kasander for 3.5 years,” he said.
Then, the defendant ART Evi was sentenced to 4 years in prison. Then, ART Sutriyah alias Triyah, ART Inda Yanti, ART Saodah, ART Pebriana Amelia, and ART Pariyah alias Ria were sentenced to 3.5 years in prison.
“Defendant Evi for 4 years, defendants Sutriyah, Inda Yanti, Pebriana Amelia, Pariyah, Saodah each for 3.5 years,” he said.
The judge stated that the defendants violated Article 44 paragraph 2 juncto Article 5 letter a Law Number 23 of 2004 concerning the Elimination of Domestic Violence (hereinafter referred to as the Domestic Violence Law) juncto Article 65 paragraph 1 of the Criminal Code juncto Article 55 paragraph 1 1 of the Criminal Code and Article 45 juncto Article 5 letter b of the Domestic Violence Law and Article 351 paragraph 1 and paragraph 2 of the Criminal Code.
