“Employee at West Jakarta District Court Caught in OTT Operation by MA”

An employee of the West Jakarta District Court (PN) was caught in a sting operation (OTT) carried out by the Supreme Court Supervisory Board (Subtract MA) on a pedestrian bridge in the Slipi area, West Jakarta.

“On Wednesday 17 May 2023 at around 14.32 WIB it took place at JPO Jalan Letjen S Parman, Slipi, Palmerah, West Jakarta,” said Supreme Court spokesperson Suharto in a statement, Tuesday (30/5).

Suharto explained that the Bawas Mystery Shopper (MS) Team had secured a sum of money from the hands of the investigators during the operation.

“The ethical hand-catching operation carried out by the MS Bawas Team is related to allegations of extortion and extortion by unscrupulous bailiffs in the process of filing a request for a postponement of execution,” said Suharto.

After being caught by the OTT, the perpetrators were immediately brought to the MA Bawas office for further investigation. In addition, the Bawas Examination Team also conducted examinations of the examinee’s direct superiors and other related parties.

After that, the perpetrator was declared guilty of violating Article 3 paragraph (3) of the Decree of the Chief Justice of the Supreme Court of the Republic of Indonesia Number 122/KMA/SK/VII/2013 concerning the Code of Ethics and Code of Conduct for Clerks and Bailiffs jo Article 5 letter l jo Article 14 letter h Government Regulations Republic of Indonesia Number 94 of 2021 concerning Discipline for Civil Servants.

Therefore, he was sentenced to severe disciplinary punishment in the form of dishonorable discharge at his own request as a civil servant.

Meanwhile, the examinee’s immediate superior was also found guilty of allowing/not forbidding or preventing the examinee from committing the extortion act even though he already knew about it.

The examinee’s superior was proven to have violated Article 6 paragraph (3) of the Decree of the Chief Justice of the Supreme Court of the Republic of Indonesia No. 122/KMA/SK/VII/2013 Concerning the Code of Ethics and Code of Conduct for Clerks and Bailiffs jo Article 3 letter f jo Article 11 letter f Government Regulation of the Republic of Indonesia Number 94 of 2021 concerning Discipline for Civil Servants. Thus, the superior was sentenced to severe disciplinary punishment in the form of release from his position to become an executor for 12 months.

Suharto explained that the ethical hand-picking operation carried out by the MA MS Bawas Team was a form of commitment by the leadership of the institution to clean up and eradicate extortion, bribery and corruption within the Supreme Court and the Judiciary under it.

He said going forward, this operation would continue to be encouraged and continued on an ongoing basis to all work units under MA throughout Indonesia.
