Emirates News Agency – ‘Pension’ clarifies conditions for policyholders’ participation and employers’ submission to Pensions Law provisions

ABU DHABI, 12th December, 2020 (WAM) — The General Authority for Pensions and Social Security has said that the private sector policyholder’s registration with the Authority is the first step towards enjoying the insurance benefits provided by the social security of the Authority, in addition to the concessions provided by the “Nafes” program for workers in the private sector.

Mohammed Saqr Al Hammadi, director of the pension operations department, explained that registration for citizens working in the private sector is mandatory under the provisions of Federal Law No. (7) of 1999 for pensions and social security and its amendments, which obliges employers to register the insured person immediately after starting work when the conditions of inclusion apply to him.

He adds that as part of the Authority’s awareness campaign on the rights of workers in the private sector who adhere to the “Nafes” initiative, the conditions for enrollment of citizens working in the private sector are that the age of the insured at The hire must be no less than (18) and no more than (60) years of age, and who is medically fit to work. Subject to appointment, according to a Medical Authority Medical Report approved by the Authority. It is also a condition for participation that the policyholder has UAE nationality, indicating that all provisions relating to registration apply to anyone acquiring UAE nationality at any time.

Al-Hammadi clarified the conditions for employers to be subject to the provisions of the pension law. He said, “Employers in the private sector in all emirates of the country are subject to the provisions of the Pension Act, except for employers in the private sector in the Emirate of Abu Dhabi,” indicating that companies whose headquarters is located in any of the emirates are subject to the provisions of the Federal Pension Law, including their branches in the other emirates.As regards entities having a main center for their management in the Emirate of Abu Dhabi, they are subject to the law on Abu Dhabi guest houses, including their branches in the other Emirates.

He added that the conditions for submitting to the provisions of the law apply to free zones and entities operating in the tourism and hotel sector that employ national workers, and if they verify their legal position regarding compliance with the provisions of the law, they must register their employees to the Authority, as is the case for all employers to whom the conditions apply.

He points out that these bodies are only required to register with the Authority if a citizen joins them, and if their staff lacks any citizen, they are not required to register with the Authority.
