The man had lost a case at the court in Rotterdam and appealed to the Council of State. Until the highest court has ruled, he must continue to receive shelter. The Council of State determined this late last night in an emergency ruling.
In principle, the statement only applies to this man, ‘but it is indicative. Anyone else who would come to us now would receive the same verdict,’ says the Council of State.
The man from Tanzania was living in Ukraine with a temporary residence permit when Russia invaded that country. He fled to the Netherlands and was given the same protection as Ukrainians.
Stop protection
The cabinet wants that protection for ‘third country nationals’ to end on Monday. They then threaten to have to leave the shelter and end up on the street. They must then apply for asylum, otherwise leave the Netherlands within 28 days.
The court in Rotterdam previously ruled in favor of the State. The government had the right to stop the protection. The man has appealed against this, but with that he would still end up on the street on Monday.
In any case, the Council of State has put a stop to this. He will continue to receive protection pending a verdict. “This also means that he does not have to leave the shelter next Monday.”
It is not known when the Council of State will rule on the status of the third-country national. The highest court expects to rule in November at the earliest.
