Elementary School Teacher Deemed Victim of Work Accident After Student’s Death Threats

(Lévis) The Administrative Labor Tribunal of the Chaudière-Appalaches region has concluded that an elementary school teacher suffered a work accident after a student brought knives to school and told his classmates that he planned to kill her.


The teacher, identified only as KR in the ruling, says the incident in November 2019 and the boy’s continued presence in his class caused him to have an anxiety disorder.

A school daycare worker found four butter knives in a seven-year-old’s backpack after other students told her the boy was planning to kill, court says his teacher.

As the students told the teacher about the incident, her colleagues didn’t say anything to her until the boy had spent the morning in his class.

The Commission for Standards, Equity, Health and Safety at Work (CNESST) initially sided with its employer, a school service center near Quebec (designated as the Center de service school A in the judgment) and dismissed his work accident claim.

However, the court overturned the decision, in part because receiving death threats is not part of the duties expected of a second-grade teacher.
