Elektra Group seeks to prevent three SCJN ministers from discussing tax debt

Mexico City. Grupo Elektra, led by Ricardo Salinas Pliego, seeks to prevent ministers Alberto Pérez Dayán, Lenia Batres Guadarrama and Yasmín Esquivel Mossa from participating in the discussion scheduled for this Wednesday on the protection it promoted, with which it seeks to avoid a tax debt of more than 33.3 thousand millions of pesos, the largest trial he faces.

In electronic lists of the Court, this Tuesday the agreement was published by which the high court is requested to declare the three ministers prevented from hearing the direct protection under review 6321/2024, in study by Pérez Dayán in the Second Chamber.

The discussion of the matter is scheduled for this Wednesday, however the Second Chamber must wait for the request for legal impediment to be resolved, which was transferred to the study of Minister Jorge Mario Pardo Rebolledo.

With this protection, Elektra seeks to avoid paying a 2013 tax credit that, according to the federal government, totals 33 thousand 306 million 476 thousand 349 pesos including updates and surcharges.

Last week, the Second Chamber postponed the discussion of a project by Yasmín Esquivel on Elektra’s protection number 5654/2024, with which the company seeks to clear the payment of 1 thousand 431 million 466 thousand 606 pesos.

The project is about to agree with the SAT, so Elektra promoted another legal impediment so that Esquivel and Batres do not know about the matter.

“The impartiality with which he can resolve the matter is clear, since it is public knowledge, that it is in the interest of the current President of the Republic (AMLO), to collect the taxes determined from Grupo Elektra, SAB de CV, despite the fact that the same They are still in litigation.

“Therefore, there is a well-founded fear that the Minister Speaker (Yasmín Esquivel), who agrees with the transformation of the country, supports the government in its incursions into the Judiciary, defends the position of the executive; have the criteria to resolve the matter impartially, helping the government to collect taxes, even without really analyzing the unconstitutionality that arose in the matter,” Elektra argued in the impediment.

In the list of matters for this Wednesday of the Second Chamber, the discussion of two projects by Minister Lenia Batres Guadarrama on the direct protection under review 3842/2024 and the appeal 419/2024 of Elektra, on calculated tax debts, was also scheduled. at around 6 million pesos.

However, Elektra also promoted a third impediment for Batres not to participate in that matter, an appeal that was referred to the study of Minister Loretta Ortiz Ahlf.
