Egyptian Administrative Court Rejects Appeal Against Appointment of President of Court of Cassation: Lawyer’s Challenge to President’s Decision

On Wednesday, the Administrative Court in Egypt rejected an appeal submitted by prominent human rights lawyer, Nasser Amin, against the President of the Republic’s decision to appoint the President of the Court of Cassation, Counselor Hosni Hassan Abdel Latif, considering it “contradicts the constitution.”

The lawyer had announced a few days ago that he had filed an appeal against the decision of President Abdel Fattah El-Sisi, last month, to appoint the president of the Court of Cassation, “because the decision violated the provisions of the constitution and the decision was affected by fundamental defects, including defects in form, deviation of authority and violation of the law.”

Amin explained that he submitted the appeal on behalf of the human rights “Justice Support Foundation”, which he heads.

Site mentioned Mada Masr The Administrative Court, headed by Counselor Ahmed Abboud, ruled, on Wednesday, not to accept the appeal against the appointment of Abdel Latif as president of the Court of Cassation, “although he is the eighth in the order of seniority, while the constitution requires choosing only among the oldest seven.”

The court attributed this to “the absence of the status and interest of the human rights institution.”

In statements to Mada Masr, Amin described the decision as “the fastest ruling in the history of the State Council courts,” adding, “I expected the court’s desire to end the case, but I did not imagine that this would happen in a few hours, and I am preparing to appeal the ruling.”

The lawyer wrote on the “X” platform that “due to the lack of capacity and interest in ‘supporting justice’, the administrative judiciary refuses to invalidate the appointment of the new president of the Court of Cassation.”

Amin argued, during the first session out of three sessions held to consider the case, that “the Judicial Authority Law in its recent amendments granted the President of the Republic the absolute right to choose the heads of the supreme judicial bodies, including the President of the Court of Cassation in charge of managing the affairs of judges and justice in the country, in violation of the principle of The independence of the judiciary,” stressing that it also “contradicts the provisions of the constitution that affirm the rule of law, and guarantee the separation of powers and the independence of the judiciary.”

The lawyer emphasized that Sisi’s choice of Abdel Latif, who is the eighth in the order of seniority among the deputies of the President of the Court of Cassation, “is a constitutional and legal violation,” stressing: “We accepted the reduction of the guarantees of the independence of the supreme judicial bodies after they were previously fortified by the principle of seniority, but the authority was not satisfied, and it overtook on the terms it set itself.
