Educational engagement contract: what is it?
The educational engagement contract (CEE) is a special employment contract offered to people who have a professional activity of facilitator, educator or director of a collective reception of minors such as a holiday or leisure center. . This contract is concluded between a town hall or an association which organizes holiday or leisure centers for minors and a facilitator, an educator or a center director. This is a specific contract which derogates from certain rules provided for by labor law in terms of working time, remuneration and rest.
The cumulative duration of one or more educational engagement contracts by the same person may not exceed 80 days per period of 12 consecutive months. If this period is exceeded, the activity is no longer considered occasional and therefore no longer falls under the educational contract.
Content of the educational engagement contract
The educational engagement contract must include the following mandatory information:
- the identity and domicile of the employee and the organizer of the holiday or leisure center;
- the amount of remuneration including benefits in kind included;
- the number of days worked and the number of rest days planned;
- the duration of the contract and the conditions for early termination.

Working week
The rules relating to the legal working time provided for by the Labor Code do not apply to the EWC. The number of hours worked per week must not exceed 48 hours over a period of 6 consecutive months.
On the other hand, the Labor Code applies to this contract with regard to:
- Break times of at least 20 minutes when the daily working time exceeds 6 hours.
- Hours worked at night. Animators who stay on, even if they have a bed and sleep, are not considered to be on daily rest. This time is considered as working time.
Educational engagement contract and rest
The holder of the educational engagement contract is entitled to a minimum rest period of 24 consecutive hours per 7-day period.
Each day, he benefits from a rest period of at least 11 consecutive hours per 24-hour period. If the employee is housed on site, this rest period of 11 hours may be taken in a fractional manner. If the employee lives at his home, this 11-hour rest may be reduced to 8 hours if, for example, his home is close to the place of the center and his presence is only necessary when minors get up and go to bed.
Remuneration within the framework of an educational engagement contract
The employee’s remuneration is fixed in the employment contract but must not be less than 22.55 euros gross per day. Compensation and benefits in kind may also be granted to him. If the employee is required to be present continuously with minors, food and accommodation must be paid for by the employer but cannot be considered as benefits in kind.
End of the educational engagement contract
The EWC ends on the expiry date specified in the contract. It can also be terminated before its term by agreement between the employee and the organizer of the holiday or leisure center. It is also possible for the organizer to terminate the contract in the event of force majeure, serious misconduct on the part of the employee or the impossibility for the latter to continue to exercise his functions.
