The Privacy Collective, a new Dutch foundation that acts against violations of privacy rights, has started a mass claim against the American tech groups Oracle and Salesforce. The foundation reports this on Friday.
The foundation opts for a mass claim, in which compensation is demanded for a large group of people. Depending on the number of victims, the damage could amount to more than 10 billion euros, The Privacy Collective thinks.
According to lawyer Christiaan Alberdingk Thijm, who assists The Privacy Collective, this is “one of the largest cases of unlawful processing of personal data in the history of the internet”. “Almost all Dutch people who read or view information online are structurally affected by practices of Oracle and Salesforce, which only serve a commercial purpose.”
According to the foundation, Oracle and Salesforce collect a lot of information to compile personal profiles of users. “Most people do not know that they have such an online ‘shadow profile’,” says Alberdingk Thijm. “They do not know what it looks like and certainly have not given legitimate consent to it. They violate the right to privacy of internet users.”
The judge must determine whether The Privacy Collective is right. Salesforce and Oracle say to it FD that the claim is “unfounded and misleading”.
