Don’t have the PEC? Here’s who will be fined if they don’t have it

In a article previous we discovered that among the novelty of the Highway Code there is the mandatory PEC for motorists. In this we will see the categories required by law to have a PEC.

Before getting to the heart, let’s take a step back for the benefit of the less technological.

Certified Electronic Mail (PEC) is a communication system similar to standard electronic mail; plus some security and certification features of the transmission that make the messages opposable to third parties.

In fact, the PEC has the same legal value as a registered letter with acknowledgment of receipt.

In recent years, some government directives have indicated the PEC as a tool of primary importance for Public Administrations.

The use of Certified Electronic Mail is rapidly spreading also in many other sectors as it allows to replace the registered letter and the fax in official reports; it can also be used for the forwarding of communications that certify the sending but do not require certification of delivery (for example invoices):

Here is the list of categories subject to the mandatory nature of the PEC:

– Professionals. The obligation began in November 2009 for the orders and the colleges to which they are enrolled.

– Society. The new companies must declare the PEC box when registering with Business Register. Since November 2011, all companies must have declared the PEC box to the Business Register.

– Individual firms. The new VAT numbers and Individual Companies, including artisans, must declare the PEC box when registering with the Business Register. Since the end of June 2013, all sole proprietorships must have declared the box to the Business Register.

– Public administrations. They must equip themselves with certified mailboxes, if they have not already done so according to previous regulations.

If you are in one of these categories make sure you have communicated it. The risk is to incur hefty fines.
