Elle had filed a complaint for sexual assault and defamation against the real estate developer. The lawsuit, initiated in civil court in Manhattan, involved only financial penalties, not any prison sentence. Donald Trump, however, was found guilty of the facts with which he was charged, which occurred in a fitting room of the Bergdorf Goodman store on Fifth Avenue, very close to the Trump Tower, in late 1995 or early 1996.
