Former American President Donald Trump is officially appealing the decision that he is not allowed to participate in the Republican primaries in Colorado. The Colorado Supreme Court ruled him out in December over his role in the 2021 Capitol storming.
The appeal is before the U.S. Supreme Court.
Trump would like to participate in the presidential elections in November. But in the states of Colorado and Maine he was excluded from participating in the primaries. These are the elections in which it is determined who the Republican and Democratic parties put forward as candidates.
This happened on the basis of a provision in the constitution that states that persons who have caused an uprising may not hold public office. In Maine, the decision was made by the top election official. Trump has also appealed in that state.
Trump is the first presidential candidate in American history to be ineligible for the White House under this provision. The Colorado Supreme Court said in December that Trump had “disqualified himself.”
During a speech on January 6, 2021, Trump incited the mob that breached the Capitol, the Supreme Court said. In addition, Trump was not protected by the First Amendment of the US Constitution, which guarantees freedom of speech.
Trump’s lawyers disagree. They honor that Trump participated in an insurrection and believe that the highest court should hear the case.
