No mercy for Markus S. (29): Dominik Brunner’s murderer had already served his imprisonment in May 2019, but now has to go back to prison. Before the local court he admitted cocaine use – a violation of his conditions. For this he received nine months without parole.
Munich – December 1st, 2006 marked a turning point in the life of Markus S. (29). At that time just 15 years old, the native of Munich was convicted for the first time in his life: for theft. Five more sentences should follow in a life in which S. spent more time in prison than in school. The negative climax: the murder of Dominik Brunner in September 2009.
Trial in Munich: Markus S. has violated his leadership requirements
Markus S. spent nine years and ten months in juvenile detention. He was released on May 14, 2019, but only under strict conditions: he has to wear an electronic ankle cuff for a period of five years, and Markus S. is not allowed to consume alcohol or drugs, since according to the judiciary there is otherwise an “increased potential for violence”.
Since yesterday it has been clear: Markus S. has to go back to prison. Because he not only violated these leadership conditions once after imprisonment, but twice. The Munich District Court * sentenced S. to nine months in prison. He’ll almost certainly appeal.
Markus S. called Judge Isabell Pisall’s judgment “ridiculous”. She had previously found harsh words for the convicted murderer, who admitted to having used cocaine twice in the summer of 2020, thereby violating the conditions. “You should have let it go,” rebuked the judge. “I can no longer suspend the sentence.”
Trial in Munich: Markus S. made a “fantastic development”
Bitter for Markus S .: He has had a job since imprisonment and is engaged. “I got the curve,” says the 29-year-old, two probation officers certify that he has made a “fantastic development”. But the truth is also: Just six weeks after his release from prison for murder, S. celebrated in a Munich disco in June 2019 and drank alcohol. The ankle shackles came loose – and that called the police * on the scene, who picked him up with more than one per mille in his blood. The district court sentenced Markus S. in December 2019 to three months’ imprisonment on probation. The probation period was two years. S. could not be guilty of anything wrong for that long. “He seems to be getting his life under control,” was the judgment of the court. And was wrong.
Because in the summer of 2020 S. is said to have consumed “cocaine in no small amount” twice. He admitted that on Thursday, but also said: “I had to find my way around after imprisonment and I regret the consumption. But now I’ve found my place – for the first time in my life. Please give me a chance! “
Trial in Munich: Markus S. could even have got three years
Judge Pisall refused. “You already had your last chance.” She could even have imposed up to three years in prison. The amount of cocaine use is insignificant – what counts is the double breach of leadership.
To the incomprehension of defender Maximilian Pauls. He argued that Markus S. only found traces of cocaine degradation. Proven by two urine tests in June and August 2020. A toxicological report is missing. In addition, it is unclear where S. took the drugs. “He’s leading a regular life, for the first time. Do you want to take that away from him now? ”Only the appointment process should decide. *tz.de/muenchen is an offer from IPPEN.MEDIA
