It was one of the flagship measures announced during the ” Grenelle »Against domestic violence in the fall of 2019. The anti-rapprochement bracelet will be operational on Friday 25 September, according to a decree published in Official newspaper. It will initially be accessible in five jurisdictions (Angoulême, Bobigny, Douai, Pontoise and Aix-en-Provence) before being deployed throughout the territory.
The Keeper of the Seals Éric Dupond-Moretti must go to the Pontoise judicial court on Thursday, September 24 for the commissioning of this bracelet.
1,000 bracelets available
At the moment, around 1,000 bracelets are available. They will be issued gradually, on a case-by-case basis in cases of domestic violence. the device makes it possible to geolocate violent spouses or ex-spouses and to trigger an alert when they approach their victim. Already used in Spain where it has proven itself, the device has been in demand for years.
The bracelet will be administered by decision of a judge, both as part of criminal proceedings, to accompany judicial review, and as a conviction. It could also, and this is a novelty, be administered in civil proceedings, by a family affairs judge, as part of a protection order for a woman who denounces violence and who is considered to be in danger. In this case, the spouse’s agreement will be requested before fitting the bracelet. In the event of a refusal, the judge may refer the matter to the prosecution to open a criminal investigation.
According to official figures, the number of feminicides increased sharply in 2019: 146 women were killed by their spouse or ex-spouse against 121 in 2018.
