She had been longing for this day for over a year: 13 months after filing for divorce, Kim Kardashian is now officially single again. The Los Angeles judge granted the 41-year-old’s request and ruled that her marriage to Kanye West is now considered a divorce.
The divorce modalities from separation of property to custody of the four children should be decided separately from the relationship status. This so-called “legal dichotomy” is allowed under California law because it gives spouses the option to remarry — without having to settle disputes with the ex-spouse. Kanye had opposed his ex-wife’s proposal – hoping to be able to convince her to come back to him.

Kardashian appeared conservatively in a black blouse and hair tied back in Steve Cochran’s courtroom via video link. Her star lawyer Laura Wasser was there. West, who decided against a virtual appearance, was represented by his new (and already 4th) attorney Samantha Spector.

–The hearing began with the judge asking Kardashian how North (8), Saint (6), Chicago (4) and Psalm (2) are doing. Kim replied: “You are all fine. We have a lot of fun together.” Kardashian smiled gratefully when Cochran told her that he had declined to show pictures of the children to protect their privacy. Kim then swore again under oath that all of the statements she made in the court documents are accurate, her marriage is “irrevocably broken,” marital therapy cannot save the relationship, and that she has a desire to regain single status.
Her attorney, Laura Wasser, informed the court that “I don’t expect there will be a custody dispute.”
But then there was a dispute about two applications from West. He requested that Kardashian be denied access to trust funds created during the marriage until a settlement is reached. He also demanded through Spector that “marital privilege” be removed. This means that all ex-spouses’ conversations can be officially listed in court documents. Wasser appealed: “There is no precedent for such a request. West is just trying to make it harder for Ms Kardashian to remarry in the future.”

In addition, the judge on the west side forbade the disclosure of spouse conversations in applications – because they would then become public. In addition, Kardarshian is allowed to divert money from the trust funds, since the distribution of the money is already determined in the pre-nuptial agreement between the two.
The next hearing is scheduled for August 5, when motions from both sides are expected to be brought in for financial settlement and custody.
