In the case of Fidel Mendoza, “the house was property of his company, but the former administrator appeared as the owner and he never changed the property to his name,” a discussion that had been going on for several years.

ATTACKS AND SIGNALINGS

According to the complaints presented to the FGE, in February of this year Fidel was in the middle of attacks on two occasions, in front of witnesses, within the subdivision near his home. The first time they approached the family, asking about a certain Pablo and “if the dog bites.” They shot two neighbors, one of them, of American origin, was wounded, and Fidel was unharmed; In the second case, they arrived at the house of a neighbor who was a friend of the Mendozas, asking for “Pedro, the mechanic.” Fidel was in the house, but fled towards the road in search of a National Guard patrol, from whom he asked for help.

Both times, a subject based in Ensenada, named Diego Martín Lázaro García (He is presumed innocent until his responsibility is declared by the judicial authority. Art.13, CNPP), was armed and led the group.

In that second armed approach, Diego Martín was detained by the National Guard along with Arturo N and Pablo N, but they were released by a preventive judge even though Lázaro had a prison record.

KIDNAPPING AND HOMICIDE

According to the statements contained in the case files, the attacks escalated on Friday, June 21, when Fidel and his wife – accompanied by a third party whose destination is not detailed – were leaving the San Antonio de Mar subdivision and were intercepted by a group of five armed men in a van, they again recognized Diego Martín Lázaro García.

The attackers took Fidel out of the car and beat him; when he tried to flee, they shot and wounded him. In a matter of seconds they put him in the truck, took the woman out, took her cell phone and also took the family car, so it took her several minutes to get a phone to call for help.

The call to the emergency room was made by his daughter-in-law and she reported an armed kidnapping. In response to the complaint, “an old man of about 70 years old arrived,” and they claim that they did not want to help them.

“Weeks ago, Fidel broke a pen at the entrance because they wouldn’t let us enter, and in less than 20 minutes seven patrols surrounded his house,” they recalled.

After taking the victim, the family reported and asked for help to locate him, but they did not hear anything until three days later. Fidel’s tortured corpse was located at six in the morning on Sunday, June 23, 2024, under the Punta Bandera bridge, wrapped in a colorful blanket, among the garbage.

As it was not far from his home, investigators presume that the place where his life was taken is in the same area, but they have not located it.

Diego Martín, the alleged perpetrator, was arrested on June 25 in Ensenada for committing another crime, car theft, and placed in preventive detention. Just the first week of November, when they searched for him again in the system, they found him in prison, and the FGE requested and obtained another arrest warrant, which it has not yet executed. The elements at its disposal are not enough to prosecute him for homicide, So they accused him of Fidel’s kidnapping with three aggravating circumstances:

– That during their captivity some injury is caused to the victim.

– That acts of torture have been carried out against the victim.

– That during or after his captivity, the victim dies due to any alteration in his health that is a consequence of the deprivation of liberty.

Regarding the motive, complaints of dispossession are one of the lines of investigation.
