The Disciplinary Plenum of the Supreme Court decided to dismiss five judges, due to severe delays in the execution of their duties. A trial judge was not dismissed. He was late due to serious health problems. In the end, he canceled the delays and will remain an officer of Themidos. The Disciplinary Plenary was presided over by the President of the Supreme Court, Ioanna Klapa-Christodoulea, and attended by the Prosecutor of the Supreme Court, Georgia Adelini.
The decision:
The Plenary unanimously decided on the definitive suspension of a primary judge, while maintaining her ability to work in the State. The first judge showed delays even as a paredor when she first joined the judiciary. As evidenced by the annual inspection reports, the arrears per year ranged from 36 to 130 cases. Repeatedly, 73, 61, 53, etc. were taken from her. case files, during various judicial years. Disciplinary penalties of a fine of one and three months had been imposed in the first trial and it had been deemed non-appealable. For its delays, there were still protests from the Bar Association, as well as from the parties, while the delays had an increasing rate. The standard dismissal procedure was followed for the remaining 4 four judges.
According to the recommendation, in 11 out of 12 inspections she was cited for delays, as well as being unconscionable, burdening her colleagues with cases that were taken away from her and billed to others, and harassing lawyers and litigants. In the Plenary, with the question of dismissal, a second trial judge had been referred. She had long delays in the issuance of decisions ranging from 22 to 100 per year, while she had 11 disciplinary decisions against her that imposed fines of deprivation of salary from 10 days to one month. In fact, in a case where it took 29 months to issue a decision.
According to the Areopagite rapporteur, the first trial had long delays in the previous years, but according to the last inspection report the delays had almost disappeared and she recommended not to stop, as there is no reason. The first judge stated that she had been dealing with consecutive very serious chronic health problems for a long period of time. He had undergone surgeries and was on sick leave for 11 months. She later broke her arm and put it in a cast. Despite the difficulties, he zeroed in on delays.
